I kept reading rumors on LinkedIn and Twitter all week about a possible second lottery to be run by USCIS. This means that H-1B registrations that were submitted but not selected would have a second chance at being selected. USCIS never confirmed or denied these rumors, and I had assumed they would notify the public if a second lottery would be done. To my surprise, this morning I received an email from the myUSCIS account with the subject line “We have taken an action on your case.” Once I logged in, I noticed some of the H-1B lottery registrations changed from “Submitted” to “Selected.”

It looks like companies can start filing new H-1B cap cases for any new H-1B registration selections beginning on Monday!
A couple of things to keep in mind:
The H-1B cap petition must include a start date of October 1, 2020, or the petition may be rejected
File your LCA's well in advance of October 1st to avoid any possible issues or delays
Remember, the USCIS fee increase and a new Form I-129 H-1 will take effect on October 2, 2020
The deadline to file new cases is November 16, 2020. If you have any new H-1B registration selections, please contact your attorney to begin the process of filing the case.
