The Rumors Were True – USCIS Has Run a Second H-1B Lottery!

I kept reading rumors on LinkedIn and Twitter all week about a possible second lottery to be run by USCIS. This means that H-1B registrations that were submitted but not selected would have a second chance at being selected. USCIS never confirmed or denied these rumors, and I had assumed they would notify the public if a second lottery would be done. To my surprise, this morning I received an email from the myUSCIS account with the subject line “We have taken an action on your case.” Once I logged in, I noticed some of the H-1B lottery registrations changed from “Submitted” to “Selected.”

It looks like companies can start filing new H-1B cap cases for any new H-1B registration selections beginning on Monday!


A couple of things to keep in mind:


  • The H-1B cap petition must include a start date of October 1, 2020, or the petition may be rejected

  • File your LCA's well in advance of October 1st to avoid any possible issues or delays

  • Remember, the USCIS fee increase and a new Form I-129 H-1 will take effect on October 2, 2020

The deadline to file new cases is November 16, 2020. If you have any new H-1B registration selections, please contact your attorney to begin the process of filing the case.
